Town of Vienna
Planning Board (PB) - Regular Meeting September 17, 2026

Call to order: Chairman Orrin MacMurray (Mac) called the meeting to order at 7:00 pm with a quorum of all 7 members.

Attendance:

Board Members: Orrin MacMurray (Mac), Bill Shaughnessy, Dave Carpenter, Mike Fischer, Miranda Ward, Tammy Crawford, and Martha Link.

Others: Secretary Kathy Pavelock and Town Council Liaison Darrin Smith. Codes/Zoning Officer Tyler Kimball was unable to attend. There were no other attendees.

Minutes Approval:

Mike Fischer made the motion to approve the August 20, regular meeting minutes with amendments to the Oswego Rd Mine discussion items, seconded by Bill Shaughnessy. Poll vote:

Orrin MacMurray – Aye

Bill Shaughnessy – Aye

Miranda Ward – Aye

Tammy Crawford – Abstain

Mike Fischer – Aye

Martha Link – Nay

Dave Carpenter – Aye

Motion Carried 5 to 2.


Correspondence: Secretary Pavelock summarized the correspondence on the agenda including:

-- Prepared and sent a Request for Information to Payne Construction and Depot Engineering for information related to the Oswego Rd mine. Received a copy of the issued Mine Permit from Payne Construction. The final site plan and SEQR Parts 2&3 have not been received from Depot Engineering. Mac requested that the secretary follow up. Martha Link provided a “DEC Responsiveness Summary” document for the Planning Board file.

  • Prepared copies of requested materials and the 8/20/2026 PB recording for Martha Link.

  • Sent training opportunities to Martha and Mike who still need training hours for 2026.

  • Received a text from Mark Newman. He is still waiting for approval from the Health Department. As soon as he receives this, he will submit an application for a Special Use Permit for the addition of sites at the Treasure Isle RV Park.

Other:

  • Due to the light agenda this evening, the PB agreed that the special meeting scheduled for October 1, 2026, to go over Zoning Law changes can be canceled. Kathy will notify the media and Town Clerk.

  • Zoning Law Updates

    • Mac explained that Draft 5 of the proposed Zoning Law will incorporate the Town Council (TC) suggestions. The TC was provided Draft 4 at the beginning of August.

    • Mac provided a handout dated September 17, 2026, which summarized the TC working meeting held on September 9, 2026. He went over the list of 13 items that he received from the TC.

    • Mac will provide Draft 5 to the TC on October 7. This version should also go to the Town Attorney for his review. The PB will then wait for further action from the TC (i.e. SEQR, Public Hearing, etc.).

  • North Bay Apartments – Eric Koester was at the last TC meeting, and it appeared that he was going to ask for a Zone Change for his property. Eric contacted Secretary Pavelock and stated that he was also going to pursue a Use Variance. Liaison Smith stated that he would take the lead in the potential Zone change.

  • Mike Fischer stated that he would like to propose some ZL changes for Accessory Dwellings. He will provide some suggestions for the PB to discuss for future ZL changes.

Next Meeting: Regular meeting is scheduled for October 15, 2026. New agenda items are due to the secretary by October 8, 2026.

Bill Shaughnessy made a motion to adjourn, seconded by Mike Fischer. Motion carried 8:25 pm.
