Town of Vienna Planning Board - Regular Meeting

October 20, 2022

Call to order: Chairman Calvin Collins called the meeting to order at 7:00 pm with a quorum present.

Attendance:

Board Members: Calvin Collins, Orrin MacMurray, Dave Gigon, and Bill Shaughnessy.

Martha Link was unable to attend and there are two vacancies on the board.

Others:, Liaison Gail Whitham and residents/applicants.

Secretary Kathy Pavelock and Codes/Zoning Officer Reay Walker were unable to attend.

Minutes Approval:

A motion was made by Bill Shaughnessy, seconded by Orrin MacMurray, to approve the September 15, 2022, regular meeting minutes. Poll Vote:

Correspondence:

  • Coordinated the signing of the final plats for SUB2022-04 after receiving no recommendations from DOT and DEC.

  • Provided draft Sept. 15, 2022 minutes to Zoning Board of Appeals (ZBA) for VAR2022-1 Natali request for a temporary variance for Zoning Law Section 1130A.

  • Phone call with Steven Berdan about his special use application SUP2022-02. He is out of town this month and will need to think about what he wants to do.

  • Provided the 10/12/2022 ZBA decision for VAR2022-1 to Mr. Natali to attach to a new special use permit application (SUP2022-03).

  • Dave Gigon received text messages that QCN Reporter Sue Halbritter is unable to attend this meeting and requested a copy of the minutes.

Public Hearings: none Unfinished Business:

SUP2022-02 Berdan, Steven; Special Use Permit for Golf Club Repair Business, 309 Drive 25; SR; Tax Map # 215.000-2-46.2. Mr. Berdan was in attendance to discuss his plans for a golf club repair shop. Mr. Berdan explained his plans to erect a shed at his seasonal home on Drive 25. He clarified he will be repairing golf clubs and not golf carts. The shed will use a generator for electricity on an as needed limited basis. After a brief discussion, the board classified this special use as retail sales and service which is allowed in this SR Zone.


A motion was made by Orrin MacMurray, seconded by Bill Shaughnessy to declare a Type II action under SEQR 617.5 (c)(9) and to schedule a public hearing for 7:05 PM on November 17, 2022. Poll vote:

Steven Berdan will be unable to attend the November meeting. He introduced Mr. Michael Fischer who will represent him at the next meeting in his absence.

New Business:

SUP2022-03 Gary Natali; Special Use Permit: North Shore Mobile Estates; 234 Beach Rd; RR-2; Tax Map # 214.000-1-59 – Gary Natali has re-applied for a Special Use Permit to expand the existing North Shore Mobile Estates Mobile Home Park after obtaining a temporary variance VAR2022-1 from the TOV Zoning Board of Appeals (ZBA).


Orrin MacMurray began the discussion with a summary of the applicants plans. At the last Planning Board meeting the special use permit application (SUP2022-1) was denied due to the requirement of 2 driveways for any additional sites for this pre-existing mobile home park. Orrin commented that the ZBA’s ruling was not consistent with the application. Liaison Whitham inquired if the site plan reviewed by the ZBA was the same as the plan being reviewed by the Planning Board.


Mr. Natali provided updates about the status with other involved agencies and the uncertainty of the entire project. Due to so many unknown items, the Planning Board agreed that a temporary zoning permit would be the best choice. Under Zoning Law Section 1910 the Planning Board may authorize the Zoning Enforcement Officer to issue a Temporary Zoning Permit for items incidental to a project. The ZBA has authorized the temporary placing of a model manufactured home on proposed site 1 of North Shore Mobil Estates. The Planning Board wishes to conduct a Public Hearing and consider this action. The board agrees this project is a Type II action under SEQR 617.5(c)(11),(21),(25).

A motion was made by Orrin MacMurray, seconded by Bill Shaughnessy to schedule a Public Hearing for 7:20pm on November 17, 2022, to consider authorizing the TOV Zoning Enforcement Officer to issue a Temporary Zoning Permit, with appropriate conditions which will allow the installation of a model manufactured home on proposed new lot No. 1 of North Shore Mobil Estates. Poll vote:

Other:

Zoning Law update – Orrin MacMurray provided an update on the status of the Town Council progress on the updated Zoning Laws and the status of the SEQR. Liaison Whitham expressed her gratitude to the Planning Board for undertaking this work.

Vacancies – The Planning Board discussed the current vacancies on this board including: the interview process, planning board involvement in interviewing, and use of alternates. The Planning Board recommends advertising for the open positions.

Next Meeting: November 17, 2022. Agenda items are due to the secretary by November 10 2022.
