Town of Vienna Planning Board - Regular Meeting

August 18, 2022

Call to order: Chairman Calvin Collins called the meeting to order at 7:05 pm with a quorum present.

Attendance:

Board Members: Calvin Collins, Orrin MacMurray, Dave Gigon, Martha Link and Bill Shaughnessy.

There are two vacancies on the board.

Others: Secretary Kathy Pavelock, QCN Reporter Susan Halbritter, and residents/applicants.

Codes/Zoning Officer Reay Walker was unable to attend. Liaison Gail Whitham was also unable to attend. Deputy Supervisor Wendy Herbst attended in her place.

SUP2022-01 Gary Natali; Special Use Permit: North Shore Mobile Estates; 234 Beach Rd; RR-2; Tax Map # 214.000-1-89 – The applicant, Gary Natali submitted his application for a Special Use Permit (SUP2022-01) to expand the existing Mobile Home Park. Mr. Natali and his engineer, Joseph Mastroianni presented details of the planned expansion including Letter from the Village of Cleveland dated 8/9/22, Full Environmental Assessment form (FEAF) part 1, and site plans.

The Planning Board reviewed the materials provided plans. Items discussed included updates to the sewer system, grading/stormwater/erosion control, water system, and sheds on the lots. The board advised the applicant that a SWPP is required for disturbing more that 1 acre of land. The applicant was also advised that a proposed sewer district would need to be approved by the town council. The planning board has authority for the special use permit only. The applicant stated the Village of Cleveland would be providing the water and sewer. The board also advised the applicant to review the town zoning law Article 11 and the Comprehensive Plan. Both items may be found on the town website.

The board agreed that this is a SEQR Type I action due to the amount of land that will be disturbed. The board will require some time to review the submitted FEAF. The board will provide comments to the secretary who will coordinate them with the applicant.

As stated last month the Zoning Officer has reviewed, commented, and submitted the application to the planning board.

The Planning Board stated that they appreciate the professional presentation of the materials.

SUB2022-04 Heather Williams (Moore Land Surveying); 2-lot subdivision; 8329 NYS Rte 13; RR-1; Tax Map # 200.000-1-21.1 Jeff Moore provided a preliminary plat showing the proposed 2-lot subdivision. This is a little complicated due to the parcel being on both sides of NYS Route

13. One lot of the proposed subdivision will remain on both sides of NYS Route 13 and the other will be on the east side with 250’ road frontage. The board discussed the option of a flag lot, but determined it was not applicable. The board asked that note 5 from the plat be included in the minutes for considering that lot 2 is conforming. “Note 5. Lot 2 shown on the plot herein has additional non-contiguous land on the west side of NYS Route 13 (See Tax Map), thus keeping the Lot 2 conforming to the Town of Vienna Zoning Regulations.”

Jeff will submit an Agricultural Data Statement since this property is an agricultural district. The board reviewed the SEQR part 1 and completed parts 2 and 3.

A motion was made by Orrin MacMurray, seconded by Bill Shaughnessy, to declare a negative environmental impact and to schedule a public hearing for September 15, 2022 at 7:10 PM. Poll Vote:

Zoning Law Updates – The Town Council is expected to take action on the proposed updated Zoning Laws in September.

Status of filling vacancies – Deputy Supervisor Herbst explained that there is nothing new to report.

Codes/Zoning Officer – The board asked Secretary Pavelock to request that Codes/Zoning Officer Walker attend the next meeting for the purpose of reviewing the plans for the special use permits. The also requested that the secretary ask about the Sterling and Coneheads change in plans for their respective special use permits.

Next Meeting: September 15, 2022. Agenda items are due to the secretary by September 8, 2022.
