Town of Vienna Planning Board - Regular Meeting

May 19, 2022

Call to order: Chairman Calvin Collins called the meeting to order at 7:00 pm with a quorum present.

Attendance:

Board Members: David Gigon, Calvin Collins, Orrin MacMurray, and Bill Shaughnessy.

Martha Link was unable to attend. There are two vacancies on the board.

Others: Secretary Kathy Pavelock, Liaison Gail Whitham, QCN Reporter Susan Halbritter, and applicants.

Minutes Approval:

A motion was made by Bill Shaughnessy, seconded by Dave Gigon, to approve the April 21, 2022, regular meeting minutes. Poll Vote:

Correspondence:

  • Submitted Legal notice and 239m referrals for Anglewood Estates SUB2020-02.

  • Received 239m referral responses from Oneida Co. Planning, NYS DOT and NYS DEC for Anglewood Estates SUB2020-02.

  • Forwarded letter from T. Moore to the board regarding proposed Zoning Law updates.

  • Forwarded NYMIR webinar opportunities to the board.


    While waiting for the appointed time for the public hearing, the board discussed the following:

    • Update on filling the two vacancies – Town Council Liaison Gail Whitham had nothing new to report. Chairman Collins stated he hope that request for candidates were being advertised.

    • Zoning Law updates – Orrin MacMurray explained that the proposed updates were provided to the town council on May 4. The town council sent thanks to the planning board for their work on the changes. Copies of the proposed law were handed out to the planning board this evening. The council has scheduled a public hearing for June 21 at the Highway Garage.

    • Other Zoning Law topics – the board briefly discussed the status of the cannabis dispensaries. The state is preparing a licensing process. This will not be ready until later this year or early 2023.

7:10 Angelwood Estates, LLC, SUB2020-02; Myers & Associates; 7-lot major subdivision on Route 49 near Drive 6; Tax Map# 214.000-1-34

Dave Gigon made a motion, seconded by Bill Shaughnessy to open the public hearing for Angelwood Estates, LLC, SUB2020-02. Poll Vote:

Unfinished Business:

Angelwood Estates, LLC, SUB2020-02; Myers & Associates; 7-lot major subdivision on Route 49 near Drive 6; Tax Map# 214.000-1-34. The planning board reviewed the final plats for several items including the inclusion of lot 7 and verify the frontage on NYS Route 49. The entire lot was surveyed and there will be two entrances on NYS Route 49. All agencies have responded to the 239m referral. Orrin MacMurray made a motion, seconded by Bill Shaughnessy to approve the Angelwood Estates, LLC subdivision SUB2020-02 with the condition that any developments of the parcels comply with NYS DOT and DEC requirements. Poll Vote:

New Business:

Oceanfront Properties NY LLC, SUB2022-02; Moore Land Surveying; 2-lot Subdivision; 9647 Elpis Rd; Tax Map# 182.000-1-6; RR3, 14 Acres. Jeff Moore representing Oceanfront Properties presented the preliminary plat for a 2-lot subdivision. There are currently two

residences on this single parcel and this subdivision will divide the parcel into two such that one residence is on each parcel. The board reviewed the Short Environmental Assessment Form part 1 and completed parts 2 and 3. Orrin MacMurray made a motion, seconded by Bill Shaughnessy to declare a negative environmental impact for SUB2022-02 and to schedule a public hearing for June 16, 2022 at 7:10 PM. Poll Vote:

Kevin Moore, Relot2022-03; Moore Land Surveying; Adjust boundary between two lots; 1491 (Moore) and 1483 (Number) NYS Rte 49; Tax Map# 216.000-1-48.1 and 48.3; SR Zone, currently

7.3 and 3 acres. Jeff Moore representing property owners Moore and Nuber, provided a final plat for review by the board. This reallotment will remove a flag lot and straighten the lot lines. The board reviewed the plat and stated that the final plat is in agreement with the sketch plan review conducted in April. The board agreed that this is cleaner, that it is a Type II SEQR and requires no public hearing. Dave Gigon made a motion, seconded by Bill Shaughnessy to approve the reallotment Relot2022--03. Poll Vote:

Sketch Plan Reviews:

Scott Zahas discussed a possible 4-lot subdivision on the corner of Yager Road and Route 13. This is in zones RR1 and RR2. The board suggested that the applicant follow the requirements for RR2. The board advised Mr. Zahas to have the property surveyed, submit an application, and come back to the planning board. Mr. Zahas was advised of the subdivision laws and process used by the Town of Vienna.

Next Meeting: June 16, 2022. Agenda items are due to the secretary by June 9, 2022.
