TOWN MEETING MINUTES
MAY 5, 2021

CALL TO ORDER:
Supervisor Graham called the meeting to order at 7:04PM. Pledge of Allegiance.

The meeting was held at the highway garage to accommodate social distancing during Covid-19.

COUNTY LEGISLATOR: NORM LEACH
Norm said that sales tax is up 22% for April. The county has acquired by agnomen domain the property for the parking garage for the new hospital in Utica.

NOCCOG: JOE ROWLANDS
Joe gave an update and the announcements can be viewed on the town web site tovlookup.org or in the Town Clerk’s Office.

PUBLIC HEARING: ZONING LAW UPDATES
Local Law #3 of 2021 A Local Law Updating the Zoning Law

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Vienna will hold a Public Hearing on Wednesday May 5th at 7:05PM at the Vienna Town Hall Via Zoom 2083 NYS RTE 49 North Bay, NY 13123 regarding Local Law #3 of 2021 Zoning Law 2021 Updates.

A copy of the Local Law is available for public inspection on line at tovlookup.org or via email by request from the Town Clerk at townclerk@tovlookup.org
At such public hearing, all persons will be given an opportunity to be heard.

A notice was put in the news paper changing the location to the highway garage so that everyone wishing to attend in person could do so.

A motion was entertained by Supervisor Graham and seconded by Councilman Davis to open the public hearing on Local Law #3 of 2021 Zoning Law Updates at 7:20pm. Motion carried.

Supervisor Graham started off by stating that no decision will be made tonight. He added that he wants to wait until Councilwoman Padavan is present before any decision is made.

A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to close the public hearing on Local Law #3 of 2021 Zoning Law Updates for the Town of Vienna at 8:05pm. Motion carried.

Councilman Davis noted that he had missed two and a half of the meetings by the committee. He expressed at the last meeting of the committee that he had concerns about the Industrial section being removed. He was not in favor of that. He reiterated that he feels it crucial that the planning board and the town board have a meeting to help them to be on the same page about things. He feels this should be at the least done on a yearly basis.

A meeting was set for 6:00pm Wednesday June 2nd one hour before the regular Town Board meeting.

AUDITED VOUCHERS:
A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to approve the audited vouchers beginning with voucher #147 thru voucher #181 in the amount of $26,636.59. Motion carried.

SUPERVISOR’S REPORT:
The supervisors report for the month of March is done and in the clerk’s office.

All OTHER OFFICES MONTHLY REPORT:
All other office reports are in the Town Clerk’s office and will be on line.

TOWN CLERK’S REPORT:
The Clerk read her report for the month of April.

HIGHWAY:
The Superintendent said they have been very busy. He said he is requesting the board have him put the 2008 ford pickup truck on Auctions International. He has been working on the funding to fix Old Route 49 so they can get the road opened again. FEMA had said they would be paying $354,182.00 but now have added an additional $122,393.00 to that. The State is going to be paying 12.5% now so the town will only have to pay 12.5% instead of 25%. After having the towns trailer taken over the weekend, it was returned damaged. No one had permission to take it, it was stolen. He feels his camera system needs updating. It is within his expenditure amounts but he wanted to let the board know. He has spoken with Russ (IT) and the approximate cost will be $1,355.00. The Highway Superintendent asked about the mowing of the fireman’s field. The town has been doing because they held summer recreation there. Since there will not be summer recreation again this year, he wants to know the board take on if the town should be mowing it or not. The board said yes and the Highway Superintendent said he can’t make it a priority but, when possible, they will mow it.

TOWN HALL:
The town hall will begin being open without an appointment starting Tuesday June 1st.

The Assessor’s Office will be going on summer hours of Tuesday through Thursday 7:30am to 3:00pm from June 1st through September 3rd.

WILLIAMSON LAW BOOK:
A motion was entertained by Supervisor Graham and seconded by Councilman Lamb to sign the contract for support with Williamson Law Book for the Codes program. Motion carried.

PUBLIC COMMENTS:
A resident spoke about having issues with lawns being left torn up after spectrum had been in laying lines. He finally had success getting them to come fix his lawn and gave the Supervisor the contact information if anyone else has issues.

A resident wanted to discuss residency requirements for Elected Officials. He spoke for a while and was eventually told this was not what a town board meeting was meant for and the issue should be resolved at the voting polls by the voters.

Mr. Piper for the record discussed the sewer and he and Councilman Lamb will look into it further to see who is responsible for the actual core drill of the man hole. The formation paperwork is not in the vault. The Town Clerk noted that she has tried to locate it on a different occasion and it is not in the vault she will check with the State and the County but really believes she has already done that in the past.
