Supervisor Spellicy:

New pickup truck is ready for the Highway, but they will not release until paid for. Tomorrow the Town Clerk and myself will write out the check and sign so Clayton can pick it up. The Town Clerk handed out paperwork from the Local Government Training that has a lot of information in it and the proposed Holiday Schedule for 2027 that needs looked over and decided on whether to follow the Federal observed Holiday days.

Teamster’s Contract

The Teamster Contract with the Highway has been fully executed. All terms discussed in Executive meetings were accepted. The Contract will be for 4 years and takes effect January 1st. This morning I met with Dave Garlock from the Teamsters. My intentions were to bring the contract back to the Board for one final read through tonight. The plan was unfortunately upset by questionable actions by a Board Member and was rushed into signing the contract in an attempt to avoid legal repercussions following the interference on behalf of a fellow Board Member, who sought to distance himself from the negotiations.

On October 8th, I was made aware that when Teamsters met with the employees for the final discussion and to vote on the proposed contract, a member of the Union had been approached and was told “I was not allowed to be part of the negotiations” and also a comment was made by the Council Member that the employees should be making what they first asked for.

This interaction was in violation of Federal Labor Relations Law and is considered to be negotiations outside of the contract stipulations and without representation present. The Teamsters have a right to bring charges before the Federal labor Relations Board for actions like this. Stating that you feel the employees should be paid more is also considered backwards negotiating. This interaction led to a contentious conversation when the Union Rep met with the employees and could have ended the negotiating process. Dave Garlock, Union Rep, made it clear to the Town employees that this was a clear attempt to gain support for something. He assured them the entire Board had seen, reviewed and had input on the final offers, which were in writing to be placed in the contract. The Town employees agreed to the terms and voted to move forward.

Previous Supervisors always did the negotiations on their own and the Board would only vote on the final product. In my attempt to get input from the Board, it created a situation where a member could either unknowingly violate the laws governing collective bargaining or in a worst case, intentionally use the information for their own personal gain. Either way, this is a violation of trust and Labor Law. I can’t ignore and hide this from the public, our Residents deserve transparency and integrity from the people they elect.

Bringing this matter in front of the Board is a matter of duty, and failure to do so would be dereliction. I do not believe the Council Member intentionally violated Labor Law, and believe it is more likely ignorance out of inexperience. We all make mistakes, but we all must answer for them. I ask the Board how we move forward on this and maintain a cohesive working relationship. Dave Garlock was very concerned and I needed to make the Board aware. For future negotiations, you can not talk to employees about negotiations in a contract situation.
