Planning Board (PB) - Regular Meeting December 18, 2025

Call to order: Orrin MacMurray called the meeting to order at 7:00 pm with a quorum of six members.

Attendance:

Board Members: Orrin MacMurray, Bill Shaughnessy, Dave Carpenter, Martha Link, Tammy Crawford and Mike Piper. Miranda Ward was unable to attend.

Others: Secretary Kathy Pavelock, Town Council Liaison Darrin Smith and several residents.

Codes/Zoning Officer Reay Walker was unable to attend.

Minutes Approval:

Bill Shaughnessy made the motion to approve the November 20, 2025, regular meeting minutes, seconded by Martha Link. No discussion. Poll vote: Orrin MacMurray – Aye Bill Shaughnessy – Aye

Martha Link –Aye Tammy Crawford – Absent for this vote Dave Carpenter –Aye Miranda Ward – Absent Mike Piper – Aye Motion Carried 5 to 2.

Correspondence: Secretary Pavelock summarized the correspondence on the agenda including:

  • Submitted 239m review for SUP2025-04 Galway.

  • On 11/25/25, we received recommendations from DEC on SUP2025-06 Equipment Building. This was due by the end of October. Copy of letter provided to applicant.

  • Coordinated the signing of the updated plats for SUB2024-04 (Christmas & Assoc).

  • Submitted legal notice for 1 public hearing scheduled for tonight.

  • Forwarded Tug Hill Commission newsletter.

  • Received H/D and WPV certificates from Bill Shaughnessy.

While awaiting the time for the scheduled public hearing, Orrin MacMurray (Mac) provided updated information pages regarding the proposed Zoning Law Changes. There are 2 new items added related to suggestions from ZBA Chairman Mike Taylor.

Public Hearings:

7:10 pm SUP2025-04 Amy Galway; Add a second residential structure to parcel; 215.000-2-10; 7800 Mill Rd; Zone RR2; 36.4 acres. Bill Shaughnessy made the motion to open the public hearing for SUP2025-04, seconded by Tammy Crawford. No discussion. Poll vote: Orrin MacMurray – Aye

Bill Shaughnessy – Aye Martha Link –Aye Tammy Crawford – Aye Dave Carpenter –Aye Miranda Ward – Absent Mike Piper – Aye Motion Carried at 7:11 pm. There were no comments from the public.

Dave Carpenter made the motion to close the public hearing for SUP2025-04, seconded by Tammy Crawford. No discussion. Poll vote: Orrin MacMurray – Aye Bill Shaughnessy – Aye

Unfinished Business:

SUP2025-06 North Shore Prop. Main. LLC (Jeff Moore); Special use permit to erect an equipment building; 217.000-2-20.2; 7596 NYS Rte., 13; Zone C. This was approved at the October meeting, assuming satisfactory responses from the 239m review. Several comments were received from the DOT and forwarded to the applicant. Jeff Moore addressed the comments, and DOT has notified us of their satisfaction with the response. Dave Carpenter made the motion to affirm the Planning Board motion from October 16, 2025, seconded by Bill Shaughnessy. Secretary Pavelock read the motion from October 16, 2025, “Tammy Crawford made the motion to approve SUP2025-06 contingent on satisfactory responses from the 239m review. The conditions of the special use permit will include: drainage shall be to the rear of the property and not to adjacent properties, the usual conditions for permits, and returning to the planning board for any significant changes to the site plan, seconded by Dave Carpenter. Motion carried 6 to 1.” Poll vote for this evening’s motion:

SUP2025-04 Amy Galway; Add a second residential structure to parcel; 215.000-2-10; 7800 Mill Rd; Zone RR2; 36.4 acres. Following the public hearing, Secretary Pavelock explained that we have heard back from Oneida County Planning and Oneida Couty DPW. We are still waiting to hear from DEC with a due date of 12/24/2025. Amy Galway was not in attendance. The board will take final action at the January meeting.

New Business: None

Sketch Plan Review: None Other:

  • Zoning Law updates. Mac continued his summary of the proposed changes, briefly addressing the following topics:

    • Tiny Homes and Accessory Apartments.

    • ZBA suggestions to clarify interpretations, including the applicant must be aggrieved and application for appeal must be with in 60 days. These are both required by NYS Town law.

    • ZBA suggestion to clarify SUP expirations and requests for extensions.

    • Commercial building size limits.

Next Meeting: January 15, 2026. New agenda items are due to the secretary by January 8, 2026.

Public Comments:

Marcy Kochanowski, 1811 NYS Rte. 49, wants to establish a dog rescue on her property which would be a new nonprofit business; The board offered advice on the process. She should discuss the plans with the Humane Society, DEC, and NYS Agriculture Department. The current Zoning Law would categorize this as a Small Business (Retail Sales & Service). She will need a documented plan and talk with the Codes Officer who will then advise to submit a Special Use Permit application.

Dave Carpenter made a motion to adjourn, seconded by Bill Shaughnessy. Motion carried 8:25 pm.
